At first I thought it may not be him since the pic is not that clear on who it is, but he released this statement
"I engaged in behavior which was regrettable and demonstrated bad judgment. I’m 23 years old, and despite the successes I have had in the pool, I acted in a youthful and inappropriate way, not in a manner that people have come to expect from me. For this, I am sorry. I promise my fans and the public -- it will not happen again."

He's a 23 year old kid who has done a ton of good things, I think he deserves a mulligan here.

I think it will be interesting to see what happens. I am sure a lot of athletes have smoked pot at that age, but he already has a DWI and now this. I think sponsors may not be that happy.

what i don't understand is they are still fiddling around to see if they are going to bring charges against him for it. so since he did something illegal and it was caught on film, than south carolina had better be prepared to arrest every single under aged person who has a photo of them in their myspace or facebook, with an alcoholic beverage

Though, you make a valid point. I think since it is an illegal drug no matter who ahs it, that helps some. I think it is just overdoing it now by wanting to charge him.

yeah they are totally over reacting to it. so he smoked some pot, who cares. the odds of him smoking regularly are pretty slim because he wouldn't have had the lung capacity to keep up with all that swimming without dying in the pool.
if they are going to press charges against him, they should really start monitoring what gets posted on the internet, because there are a ton of people doing things illegally in front of cameras. no one expects the police to show up on your door step and arrest you for what you did a month ago. if so, hell they should arrest me now cause i think i might have driven home while some vicodin was in my system still 4 months ago

Looks what you caused Brad. Just because it happened at USCe, the guy is going to get arrested and kicked out of the Olympics.
On TMZ the other day they were talking to Tommy Chong and someone asked him if he saw the pic of Phelps doing the bong hit and his reply was gold....I cant quote it word for word because I dont remember but it was along the lines of-
Yeah, I saw the pic. Looks like he can handle himself pretty good. Id hate to be the guy after him because if his lung capacity is that good being a swimmer and all, he's smoke the whole bowl in one hit.

Richland County Sheriff just announced that he will not press charges against Michael Phelps, nor anyone else involved in the incident
That guy was on a witch hunt. Glad someone told him to stop. It would be a waste of taxpayers dollar for a possesion of marijauna charge
